Are Knowsley Council acting legally and within Council procedure?
After Knowsley Council launched a legal attack on Kirkby Times - one of Kirkby
Times dashingly clever contributors has pointed out that this action may not be
legal.
The attempt to ban a local website, with no prior complaints, raises serious
questions that have to be addressed urgently. I will be taking legal advice
and there may be a case for me to sue Knowsley Council for defamation of my
character. Below are the points made by one of the contributors to Kirkby
Times. The information here has been emailed to ALL of Knowsley Councils
Councillors and the Chief executives Office.
(1) Knowsley Council is a public body, that requires the agreement of the
Full Council before any legal action taken can be taken on its behalf.
This has evidently not taken place, according to a number of its councillors.
(2) The Chief Executive has a statutory duty to discharge all his duties
impartially.
The main content of the Kirkby Times is political comment and criticism of
the political activities of a number of local Councillors, it is
likely that using council taxpayers money to fund this legal action
is motivated on behalf of one party in the council.
This therefore raises the possibility that the Chief Executive is not
acting in accordance with his statutory duties, as well as the illegal use
of public money in support of a political party. Whatever explanation may
follow, this above all is a matter that must be investigated by the District
Auditor on behalf of the council taxpayers who have foot the bill for this
legal challenge
It is therefore imperative to identify in whose name the legal
challenge was made
The story that has rocked them back on their heels is the
revelations on the Liverpool FC Academy.
If normal procedures are followed, messrs Round, O'Hare, Nolan,
and Keight should be treated exactly the same as the Liverpool crew
in the mid 80s, by acting as a star chamber in the sale of prime
development land at rock bottom prices.
